To enter the "DoorDash Fan Coach Sweepstakes" ("Sweepstakes"), you must agree to and abide by these official rules ("Official Rules").
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCE OF WINNING. You must have Internet access and an active e-mail account, Instagram, TikTok and/or X account to participate. Winners will be randomly selected.

1. SPONSOR: DoorDash, Inc. ("Sponsor"), 303 2nd St, Suite 800, San Francisco, CA 94107.
2. ADMINISTRATOR: Probability LLC ("Administrator"), 2 Woodstock Meadows Ln, Woodstock, NY 12498.
3. ELIGIBILITY: The Sweepstakes is open only to legal residents of the United States or District of Columbia, who are at least eighteen (18) years of age (or age of majority in their jurisdiction of residence, whichever is older.) Any individuals (including but not limited to employees, consultants, independent contractors [including Dashers as well as brand ambassadors/influencers], and interns) who have, within the past six (6) months, performed services for Sponsor, Administrator, any organizations responsible for sponsoring, fulfilling, administering, advertising, or promoting the Sweepstakes and/or their respective parent, subsidiary, affiliated, and successor companies (collectively, the "Sweepstakes Parties"), and immediate family and household members of such individuals, are not eligible to enter. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not. Void outside of Territory and where prohibited or restricted by law.
4. SWEEPSTAKES ENTRY: For eligible individuals, the Sweepstakes begins at 12:01 AM Pacific Time ("PT") on September 5, 2024 and ends at 11:59 PM PT on October 6, 2024 ("Sweepstakes Period"), as set forth in the chart below. Six (6) separate and distinct Sweepstakes entry periods (each, an "Entry Period" and collectively, "Entry Periods") comprise the Sweepstakes Period.

For purposes of these Official Rules, all times and days are Pacific Time. Sponsor’s computer is the official time-keeping device for the Sweepstakes.
During the Sweepstakes Period, there are three (3) ways to enter the Sweepstakes: (1) via Instagram; (2) via TikTok and (3) via X (each an "Entry"):
Entry via Instagram and/or TikTok:
During the Sweepstakes Period, Sponsor will post one (1) or more posts (each, a "Sweepstakes Post" and collectively the "Sweepstakes Posts") featuring the DoorDash Fan Coach ("Fan Coach") on the Sponsor’s Instagram and TikTok accounts during each Entry Period.
During the Promotion Period an entrant may enter as follows:
A. follow Sponsor (@doordash) on Instagram and/or TikTok
B. leave a comment on the Sweepstakes Post with your question ("Question") for the Fan Coach and include #FanCoachSweepstakes (the "Sweepstakes Hashtag") in the comments section ("Comment") of the Sweepstakes Post.
Comment must include the Sweepstakes Hashtag to be considered an eligible Sweepstakes Entry. The term "Sweepstakes Entry" includes any text that accompanies the Sweepstakes Hashtag and Comment. The text portion of the Sweepstakes Entry must be limited to the Comments section of the Sweepstakes Post (during the applicable Entry Period); if you post/re-post your Comment on your Instagram or TikTok account (as applicable) or elsewhere, it will not result in Sweepstakes Entry or improve your chances of winning a prize (assuming that the comment was also posted in response to the Sweepstakes Post as per these Official Rules).

For All Entries: Sweepstakes Entries must be manually key-stroked by the entrant; use of automated entry devices or programs, or entries by third parties by any method of entry, are prohibited. In addition, re-posting another person’s Post (in whole or in part) will NOT result in receipt of Sweepstakes Entry: the comment and Question must be solely your original work. Sweepstakes Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than stated in these Official Rules will be disqualified. Sponsor and Administrator will not be responsible for late, lost, incomplete or misdirected entries. Proof of submission of Entry does not constitute proof of receipt of same. All Sweepstakes Entries must be submitted via "post" on Instagram, TikTok or X, respectively in their entirety prior to expiration of the Sweepstakes Period (and subject to Entry Period deadlines); in addition, to participate via Instagram or TikTok, “post” must be made as a comment to the Sweepstakes Post. By entering this Sweepstakes, entrants agree to these Official Rules and the decisions of the Administrator and Sponsor, which are binding and final in all matters relating to this Sweepstakes.
Limit one (1) Sweepstakes Entry per person per platform (i.e., Instagram, TikTok or X) per Entry Period during the Sweepstakes Period. You may only use one (1) Instagram, TikTok or X account to participate in the Sweepstakes. All Comments on Instagram must comply with Instagram's policies, including its Community Guidelines, available at https://help.instagram.com/477434105621119. All Comments on TikTok must comply with TikTok's policies, including its Community Guidelines, available at https://www.tiktok.com/community-guidelines/en. All Posts must comply with X's policies, including its Rules, available at https://help.x.com/en/rules-and-policies/x-rules. Important note: If your Instagram/TikTok/X account is set to "protected mode," or "private" your updates/responses may not be visible on the @doordash account on Instagram/TikTok and @DoorDash account on X and may not thus be received by Sponsor unless you previously consented to permit @doordash/@DoorDash account to see your Instagram/TikTok/X posts.
If you opt to access Instagram, TikTok, and/or X via your wireless mobile device (only available via participating wireless carriers), data rates may apply for each message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Sweepstakes. Mobile device service may not be available in all areas. Check your phone's capabilities for specific instructions.
5. CONTENT GUIDELINES: In addition to complying with all other requirements of these Official Rules, Instagram, TikTok and/or X, each Sweepstakes Entry must not contain any content that Sponsor determines, in its sole discretion, is hateful, profane, obscene, disparaging or is otherwise inappropriate, objectionable, infringes on the intellectual property or other rights of any third party, unsuitable for the uses contemplated in these Official Rules, advocates violence or illegal conduct of any kind, addresses controversial subject matter or that denigrates/defames Mr. Bill Belichick, as determined by Sponsor in its sole discretion. Do not include personally identifiable information about you or anyone else (e.g., full name, e-mail address, residential address, telephone number) in any Sweepstakes Entry.
If a Sweepstakes Entry cannot be viewed and/or accessed by Sponsor or Administrator for any reason, such Sweepstakes Entry shall be disqualified without any fault or liability of the Released Parties, as defined below.
6. RANDOM DRAWING/SELECTION OF WINNER/ODDS: Potential Prize Winners (each a "Winner") will be selected via a random drawing on or about three (3) business days following the conclusion of the applicable Entry Period per the chart above. There will be a total of six (6) separate and distinct random drawings (each, a "Drawing Period" and collectively, "Drawing Periods"). Each Drawing Period will consist of all eligible Entries received by the end date of the applicable Entry Period. All non-winning entries from a given Entry Period random drawing WILL NOT be carried forward for any following Drawing Period (as applicable). For the avoidance of doubt, if a Sweepstakes Entry is otherwise in compliance with these Official Rules (including but not limited to the Content Guidelines in Section 5 above), the content of the Sweepstakes Entry will NOT be taken into account in the winner selection process. Drawings will be conducted by Probability LLC, an independent judging organization/Administrator whose decisions are final and binding on all matters related to the Sweepstakes.
Odds of winning a Sweepstakes prize (for a given Entry Period) depend on the total number of eligible entries received during that Entry Period.
7. WINNER NOTIFICATION: Each potential prize winner will be contacted on or about three (3) business days following the conclusion of the applicable Entry Period per the chart above via direct message on the social media platform of which they entered (e.g., Instagram, TikTok or X). It is recommended you confirm your Instagram, TikTok and/or X notification settings (as applicable) are turned on. The direct message will contain a link to a prize verification form ("Verification Form"). Potential winner will be required to complete the Verification Form within five (5) days of transmission. Upon receipt and review of the completed Verification Form by the Administrator, each potential winner will be confirmed as a winner ("Winner"). If the Verification Form is not returned to Administrator within the specified time period, or if prize notification is returned as undeliverable, or if potential winner is found to be ineligible or otherwise not in compliance with these Official Rules, or declines the prize for any reason prior to award, prize may be forfeited and potential winner may be disqualified and an alternate potential winner may be selected from all remaining eligible Entries received during the applicable Entry Period.
In the event of any dispute concerning the identity of any entrant, the Sweepstakes Entry will be deemed submitted by the natural person who is the authorized holder of the transmitting email account associated with the Instagram, TikTok or X account used to participate in the Sweepstakes. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
8. PRIZES AND APPROXIMATE RETAIL VALUE ("ARV"):
Three hundred (300) prize packages (each a "Prize Package" or "Prize", collectively "Prize Packages" or "Prizes") available to be awarded; fifty (50) Prize Packages per Entry Period: Each Prize Package will include one (1) custom DoorDash hoodie with insulated pocket and one (1) $50 DoorDash e-Gift Card (subject to Gift Card Terms and Conditions here.) Total ARV of each Prize Package: $100.00.
Total ARV of all Prizes: $30,000.00.
9. ADDITIONAL PRIZE RESTRICTIONS: LIMIT ONE (1) PRIZE PER PERSON/FAMILY/HOUSEHOLD DURING SWEEPSTAKES PERIOD. A DoorDash account is required to redeem DoorDash gift card prizes (to create a DoorDash account, a valid e-mail address and phone number is required and you must agree to the DoorDash Consumer Terms and Conditions available here). Prize must be accepted in its entirety and cannot be separated. Color, size and style of hoodie will be determined by Sponsor in its sole discretion. Any images of hoodie in advertising are for illustrative purposes only and actual hoodie awarded as part of the prize may differ from such images for various reasons; and Sponsor and Administrator disclaim any and all liability in conjunction therewith. No prize substitution except at the sole discretion of Sponsor and only then for prize/prize element of comparable value. Prize is not exchangeable or redeemable for cash except for DoorDash e-Gift Card where required by applicable law. Prize is not transferable.
Hoodie will only be delivered to a street address in the fifty (50) United States or Washington, D.C.; this address must be the Winner’s primary residence as provided by the Winner during the Winner notification process and/or in the Verification Form. E-Gift Card will be delivered to email address provided on Verification Form up to ten (10) business days after completion of prize claim procedure. Allow up to 4-6 weeks after completion of prize claim procedure for delivery of the hoodie. Tracking numbers will NOT be provided. If, after a good-faith attempt, Sponsor/Administrator is unable to award or deliver a prize, the prize may not be awarded in whole or in part. If prize is returned as undeliverable, it may be forfeited.
All taxes (including, without limitation, U.S. federal, state and local taxes (including, but not limited to income and withholding taxes) and sales taxes as applicable on or connected with the Prize, the shipment of any Prize element, as applicable, and the reporting consequences thereof, and any other expenses not specifically included in the Prize description are the sole responsibility of the Winner.
10. LIMITATIONS OF LIABILITY: Released Parties (as defined below) are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind affecting the Sweepstakes in any manner, including but not limited to electronic malfunction or damage of any network, hardware or software. In the event of any discrepancy between the provisions of these Official Rules and any marketing materials (including the prize description), the provisions of these Official Rules shall prevail and govern. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond any Released Party’s (as defined below) control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (including entries or otherwise), Sponsor reserves the right, in its sole discretion, to disqualify any individual, whether or not the individual is a participant in the Sweepstakes, who tampers with the entry process, and to terminate, modify or suspend the Sweepstakes. In such event, Sponsor reserves the right to conduct the Sweepstakes and award the Prizes for affected Entry Period(s) by means of a random drawing from among all eligible entries received for such affected Entry Period(s) prior to and/or after (as appropriate) the action taken by Sponsor in a manner which is fair, appropriate and consistent with these Official Rules, as determined by Sponsor in its sole discretion. Notice of termination/modification/suspension of Sweepstakes will be posted on @doordash on Instagram/TikTok and @DoorDash on X. No responsibility is assumed by any Released Party for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry or participation to be received on account of technical problems or traffic congestion on the Internet or at any website/platform (including filtering by or other operation of any given social media platform), or any combination thereof, including any injury or damage to any person's computer or mobile device related to or resulting from participation in or downloading any materials from this Sweepstakes. Failure of Sponsor or Administrator to enforce any provision of these Official Rules shall not constitute the waiver of such provision. All federal, state and local laws and regulations apply.
Persons entering the Sweepstakes further agree not to knowingly damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE, WEBSITE, OR PLATFORM OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PERSON, WHETHER OR NOT THE INDIVIDUAL IS A PARTICIPANT IN THE SWEEPSTAKES, MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.
11. Release of Liability: By participating in this Sweepstakes, entrants agree to release and hold harmless the Sweepstakes Parties, the management and representation of Mr. Bill Belichick (as well as Mr. Belichick personally), Meta Platforms, Inc., X Corp., TikTok Inc., as well as each of their parent companies, subsidiaries and affiliates, and their respective officers, directors, employees, agents, partners and representatives and each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes or any Sweepstakes-related activity or travel, and/or acceptance, receipt, possession or use/misuse of any Prize.
12. Publicity Grant: By entering, entrants also authorize the Sponsor and its respective designees to use their name, voice, likeness, photograph, Prize information (if applicable), biographical data and city and state of residence in programming, advertising and/or promotional material or on a Winners’ list (if applicable) without compensation, notification or permission, to the extent permitted by law. Sponsor is not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials, at Sponsor's sole discretion, without obligation or compensation.
13. Disputes; Arbitration/Choice Of Law: Except where prohibited, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or the awarding of prizes/determination of Winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of JAMS, then effective (notwithstanding the foregoing, entrant shall not be precluded from seeking relief in small claims court for disputes/claims within the scope of the jurisdiction of small claims court and any remedies available to entrant under applicable federal, state or local law remain available to entrant and are not waived pursuant to this section); (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased and any and all rights to injunctive relief. The arbitrator hearing such dispute/claim/cause of action shall be neutral and the entrant will have a reasonable opportunity to participate in the selection of the arbitrator. Such arbitration will take place at a location near the entrant’s residence and the entrant has the right to an in-person hearing in the arbitration proceeding, if desired. The arbitration will allow for discovery and/or exchange of non-privileged information between entrant and Sponsor. Should an entrant initiate arbitration pursuant to this section, the entrant shall be responsible for JAMS’s fees to do so (approximately, $250), with all other costs of such arbitration being borne solely by Sponsor. If entrant is a California resident and Sponsor prevails in such arbitration, such entrant will not be responsible for Sponsor’s costs and fees in conjunction with the arbitration proceeding; BUT, IN ALL OTHER CASES, ENTRANT WILL BE RESPONSIBLE FOR SUCH COSTS/FEES IF REQUIRED BY THE ARBITRATOR’S RULING. For the avoidance of doubt, the requirement to arbitrate disputes pursuant to this section is reciprocal and binding both upon entrants and Sponsor. IN AGREEING TO ARBITRATION, YOU ARE GIVING UP YOUR RIGHT TO TRIAL IN A COURT OF LAW. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine of California or any other jurisdiction.
14. PRIVACY POLICY: Personal information provided in conjunction with Sweepstakes entry is subject to Sponsor’s Privacy Policy accessible via www.doordash.com.
15. WINNERS’ LIST: For the names of Winners, mail a separate, self-addressed, stamped envelope to: DoorDash Fan Coach Sweepstakes, c/o Probability, P.O. Box 1559, Social Circle, GA 30025-1559, for receipt by October 30, 2024.

For the avoidance of doubt, the Sweepstakes is dormant and inactive between Entry Periods. For purposes of these Official Rules, all times and days are Pacific Time. Sponsor’s computer is the official time-keeping device for the Sweepstakes.
During the Sweepstakes Period, individuals may enter the Sweepstakes in one of two ways (each an "Entry"):

Method #2: Entry Without Purchase ("Email Entry"): To enter without placing an Order, individuals who are eligible per Section 3 above may send an e-mail with their full name, e-mail address, city/state/zip code and phone number associated with their DoorDash account to: sweepstakes@doordash.com, with the subject line "DoorDash Wendy's Extra Sauce Sweepstakes." To be eligible, Email Entry must be received during one of the Entry Periods per chart above.
While you do not need to make a purchase to enter via e-mail entry, you must have an active DoorDash account in good standing. You can visit http://www.doordash.com or download the DoorDash app on a compatible device from the iTunes App Store or Google Play and create a free DoorDash account according to the instructions on the website/app. Please note that you must agree to the DoorDash Consumer Terms and Conditions available here (including without limitation Section 7 regarding User Accounts) in order to create an account.
Limit one (1) entry per individual, per email address and/or DoorDash account, regardless of method of entry per Entry Period. Multiple entries and/or mass entry attempts in violation of this limit may result in disqualification of all entries by such person. Whether or not you place a Qualifying Order (and, if so, the retailer with whom the Order is placed, and the items purchased via the Order) will NOT improve or affect one’s chances of winning the prize in the Sweepstakes. Incomplete entries will not be accepted. Entries must be manually key-stroked by the entrant; use of automated entry devices or programs, or entries by third parties are prohibited. Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than stated in these Official Rules will be disqualified. Proof of submission of entry (including acceptance and delivery of Order, if applicable) does not constitute proof of receipt of the same. Receipt of entries may be acknowledged, but any such acknowledgment is in no way otherwise binding upon Sponsor or Administrator. By entering the Sweepstakes, entrants agree to these Official Rules and the decisions of the Administrator and Sponsor, which are binding and final in all matters relating to the Sweepstakes.
5. RANDOM DRAWING/SELECTION OF WINNER/ODDS: Potential prize winners will be selected via a random drawing on or about four (4) business days following the conclusion of the applicable Entry Period per the chart above. There will be three (3) separate and distinct random drawings (each, a "Drawing Period" and collectively, "Drawing Periods"). Each Drawing Period will consist of all eligible Entries received by the end date of the applicable Entry Period. All non-winning entries from a given Entry Period WILL NOT be carried forward for any following Drawing Period (as applicable). Random drawings will be conducted by Probability LLC, an independent judging organization/Administrator whose decisions are final and binding on all matters related to the Sweepstakes.
Odds of winning a Sweepstakes prize (for a given Entry Period) depend on the total number of eligible entries received during that Entry Period.
6. WINNER NOTIFICATION: Each potential prize winner will be contacted by email and/or telephone following the conclusion of the applicable Drawing Period per the chart above. To remain eligible for the Sweepstakes, potential winner must still have a DoorDash account in good standing at time of winner notification. Potential prize winner may be required to sign and return within three (3) days of receipt a Declaration of Eligibility, Release and Indemnification, a Publicity Release where allowed by law, as well as other documents that Sponsor may require (collectively, "Prize Claim Documents''). Prize Claim Documents will be collected by DigiSigner GmBH ("DigiSigner") and shared with Sponsor and Probability LLC solely for the purposes of Sweepstakes administration. All entrant data will be deleted from DigiSigner once winner is verified and confirmed. Upon completion and receipt of all Prize Claim Documents by the Administrator, each potential winner will be confirmed as the winner (“Winner”). If the Prize Claim Documents are not returned to Administrator within the specified time period, or if prize notification is returned as undeliverable, or if potential winner is found to be ineligible or otherwise not in compliance with these Official Rules, or declines the prize for any reason prior to award, prize may be forfeited and potential winner may be disqualified and an alternate potential winner may be selected from all remaining eligible Entries received during the Sweepstakes Period.
In the event of any dispute concerning the identity of any entrant, the entry will be deemed submitted by the natural person who is the Authorized Account Holder of the e-mail address associated with the corresponding DoorDash account and such individual must comply with these rules. "Authorized Account Holder'' is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Prizes will only be delivered to a street address in the fifty (50) United States or Washington, D.C. Prize elements may be shipped separately (if applicable). Allow up to four (4) - six (6) weeks for delivery of prize (following validation of Prize Claim Documents). Prizes are provided "as is"; entrants acknowledge that Sponsor and the Sweepstakes Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any Prize, including any implied warranty of merchantability or fitness for a particular purpose. Any prizes composed of multiple elements must be accepted in its entirety and cannot be separated. Color, size and style of various prize components will be determined by Sponsor in its sole discretion (except where otherwise noted). Any images of prizes/prize components in advertising are for illustrative purposes only and actual items awarded as prizes/prize components may differ from such images for various reasons; and Sponsor and Administrator disclaim any and all liability in conjunction therewith.
All applicable federal, state and/or local taxes as well as unspecified expenses in conjunction with acceptance and use of Prize are the sole responsibility of the Prize Winners, who will receive an IRS Form 1099 reflecting the actual final retail value of any prize valued at $600 or more. For prizes valued over $600, winners must furnish their social security number where requested on the Prize Claim Documents. Winners further agree to otherwise fully cooperate with Sponsor/Administrator as to their compliance with governmental tax-reporting requirements. Failure to do so will result in prize forfeiture.
9. LIMITATIONS OF LIABILITY: Released Parties (as defined below) are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind affecting the Sweepstakes in any manner, including but not limited to electronic malfunction or damage of any network, hardware or software. In the event of any discrepancy between the provisions of these Official Rules and any marketing materials (including the prize description), the provisions of these Official Rules shall prevail and govern. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond any Released Party’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (including entries or otherwise), Sponsor reserves the right, in its sole discretion, to disqualify any individual, whether or not the individual is a participant in the Sweepstakes, who tampers with the entry process, and to terminate, modify or suspend the Sweepstakes. Failure of Sponsor or Administrator to enforce any provision of these Official Rules shall not constitute the waiver of such provision. All federal, state and local laws and regulations apply.
Persons entering the Sweepstakes further agree not to knowingly damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes.

SPONSOR MAKES NO WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
10. Release of Liability: By participating in this Sweepstakes, entrants agree to release and hold harmless the Sweepstakes Parties, as well as each of their parent companies, subsidiaries and affiliates, and their respective officers, directors, employees, agents, partners and representatives and each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes or any Sweepstakes-related activity or travel, and/or acceptance, receipt, possession or use/misuse of the Prize.
11. Publicity Grant: By entering, entrants also authorize the Sponsor and its respective designees to use their name, voice, likeness, photograph, Prize information (if applicable), biographical data and city and state of residence in programming, advertising and/or promotional material or on a Winners' List (if applicable) without compensation, notification or permission, to the extent permitted by law. Sponsor is not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials, at Sponsor's sole discretion, without obligation or compensation.
12. Disputes; Arbitration/Choice Of Law: Except where prohibited, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or the awarding of the prize/determination of Winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of JAMS, then effective (notwithstanding the foregoing, entrant shall not be precluded from seeking relief in small claims court for disputes/claims within the scope of the jurisdiction of small claims court and any remedies available to entrant under applicable federal, state or local law remain available to entrant and are not waived pursuant to this section); (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased and any and all rights to injunctive relief. If entrant is a California resident and Sponsor prevails in such arbitration, such entrant will not be responsible for Sponsor’s costs and fees in conjunction with the arbitration proceeding; BUT, IN ALL OTHER CASES, ENTRANT WILL BE RESPONSIBLE FOR SUCH COSTS/FEES IF REQUIRED BY THE ARBITRATOR’S RULING. For the avoidance of doubt, the requirement to arbitrate disputes pursuant to this section is reciprocal and binding both upon entrants and Sponsor. IN AGREEING TO ARBITRATION, YOU ARE GIVING UP YOUR RIGHT TO TRIAL IN A COURT OF LAW. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine of California or any other jurisdiction.
