Your Door to an Epic Summer Sweepstakes (Free Groceries and Gas for a Year)
OFFICIAL RULES
To enter the "Your Door to an Epic Summer Sweepstakes" ("Sweepstakes"), you must agree to and abide by these official rules ("Official Rules").
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCE OF WINNING.
1. SPONSOR: DoorDash, Inc. ("Sponsor"), 303 2nd St, Suite 800, San Francisco, CA 94107.
2. ADMINISTRATOR: Probability LLC ("Administrator"), 2 Woodstock Meadows Ln, Woodstock, NY 12498.
3. ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States or District of Columbia who meet all of the following criteria: (a) must have a DoorDash account in good standing at time of entry; (b) who are at least eighteen (18) years of age or the age of majority in their state of residence ("Entrant");. Any individuals (including but not limited to employees, consultants, independent contractors [including Dashers as well as brand ambassadors/influencers], and interns) who have, within the past six (6) months, performed services for Sponsor, Administrator, DJE Holdings, Inc., any organizations responsible for sponsoring, fulfilling, administering, advertising, or promoting the Sweepstakes and/or their respective parent, subsidiary, affiliated, and successor companies (collectively, the "Sweepstakes Parties"), and immediate family and household members of such individuals, are not eligible to enter. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not. Potential winners must provide proof of U.S. residency upon request prior to prize award. Void where prohibited or restricted by law.
4. SWEEPSTAKES ENTRY: For eligible individuals, the Sweepstakes begins at 12:00:01 AM Pacific Time ("PT") on July 18, 2024 and ends at 11:59:59 PM PT, on July 24, 2024 ("Sweepstakes Period").
For purposes of these Official Rules, all times are Pacific Time. Sponsor’s computer is the official time-keeping device for the Sweepstakes.
DashPass Members Online/In App Entry: To enter via this method, you must (a) be a current DashPass member, (b) login to your DoorDash account either online (https://doordash.com) or via your DoorDash app, (c) create your DashPass order that (i) includes an item from the Summer of DashPass category and (ii) is from a DashPass merchant as identified on DoorDash ("Order"). Upon submission of your completed Order, you will automatically receive one (1) entry into the Sweepstakes ("Entry"). By submitting an Entry, Entrant is acknowledging and agreeing to these Official Rules. (For clarity, provided that the amount of the DashPass order meets the DashPass minimum subtotal requirement for a given DashPass merchant, the amount of the DashPass order will not improve or affect your odds of winning the prize in the Sweepstakes.) Order cannot be combined with any coupon, discount, offer or promo code. Entry will be void if (x) you are not a current DashPass member at the time you place your order, (y) order is initially accepted by Sponsor but later voided for any reason, or (z) if order is placed, does not meet the DashPass minimum subtotal requirement, or is from a non-DashPass merchant.
If you are not a DashPass member, you can visit https://www.doordash.com/dashpass or download the DoorDash app on a compatible device from the iTunes App Store or Google Play and subscribe to DashPass according to the instructions on the website/app. Please note that you must agree to the DoorDash Consumer Terms and Conditions available here (including without limitation Section 13 regarding DashPass Subscriptions) in order to subscribe to DashPass.
Email Entry Without DashPass Membership or DashPass Purchase: To enter without becoming a DashPass member or placing a DashPass order on DoorDash, send an email during the Sweepstakes Period to sweepstakes@doordash.com with "Your Door to an Epic Summer Sweepstakes Entry" in the subject line. In the body of the email, please state your name, email address and date of birth. Incomplete entries will not be valid.
While you do not need to become a DashPass member or place a DashPass order to enter via e-mail entry, you must have an active DoorDash account in good standing at time of entry. You can visit http://www.doordash.com or download the DoorDash app on a compatible device from the iTunes App Store or Google Play and create a DoorDash account with a valid form of accepted payment on file according to the instructions on the website/app. Please note that you must agree to the DoorDash Consumer Terms and Conditions available here (including without limitation Section 6 regarding User Accounts) in order to create an account.
Limit of one (1) Entry per person, regardless of method of Entry. Multiple entries and/or mass entry attempts may result in disqualification of all entries by Entrant and may constitute an act of fraud. Whether or not you place a DashPass order (and, if so, the DashPass merchant with whom the order is placed, and the items purchased via the order) will NOT improve or affect one’s chances of winning the prize in the Sweepstakes. Incomplete entries will not be accepted. Entries must be manually key-stroked by the Entrant; use of automated entry devices or programs, or Entries by third parties are prohibited. Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than stated in these Official Rules will be disqualified. Proof of submission of Entry (including acceptance and delivery of DashPass order, if applicable) does not constitute proof of receipt of same. Receipt of online Entries may be acknowledged, but any such acknowledgment is in no way otherwise binding upon Sponsor or Administrator. By entering this Sweepstakes, Entrants agree to these Official Rules and the decisions of the Administrator and Sponsor, which are binding and final in all matters relating to this Sweepstakes.
IMPORTANT: Data rates may apply if Sweepstakes entry is submitted via your mobile device according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging/data rate plans and charges relating to your participation in this Sweepstakes. Mobile device service may not be available in all areas. Check your device's capabilities for specific instructions.
5. RANDOM DRAWING/SELECTION OF WINNER/ODDS: One (1) potential winner ("Winner") will be selected from among all eligible entries received during the Sweepstakes Period in a random drawing, on or about July 26, 2024. The drawing will be conducted by the Administrator, an independent judging organization/administrator whose decisions are final and binding on all matters related to the Sweepstakes.
Odds of winning depend on the total number of eligible entries received.
6. WINNER NOTIFICATION: Potential winner will be notified by e-mail and/or telephone on or about July 29, 2024 by Sponsor, or Administrator. Potential winner must still have an active DoorDash account (and, if they entered via DashPass order, an active DashPass membership) in good standing at time of winner notification. Failure to respond to the initial notification e-mail within twenty-four (24) hours after transmission to the potential winner or return of the e-mail notification as undeliverable after two (2) attempts will result in disqualification and award of the Prize may go to an alternate winner (time permitting). Potential winner will be required to complete, sign and return within three (3) business days of transmission, an Affidavit of Eligibility, Liability Release and Indemnification, a Publicity Release where allowed by law, as well as other documents that Sponsor may require (collectively the "Prize Claim Documents"). Failure to return the completed and signed Prize Claim Documents within the indicated time period may result in disqualification, prize forfeiture and selection of an alternate potential winner from among all remaining eligible entries received (time permitting).
In the event of any dispute concerning the identity of any online/app entrant, the entry will be deemed submitted by the natural person who is the authorized account holder of the e-mail address associated with the corresponding DoorDash account used to enter and such individual must comply with these rules. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
7. PRIZE/APPROXIMATE RETAIL VALUE ("ARV"):
One (1) Grand Prize ("Grand Prize"): Winner will receive one year's worth of groceries in the form of a DoorDash eGift Card in the amount of $18,200 and one year’s worth of gas in the form of a check in the amount of $7,280 in the Winner’s name. Total ARV of the Grand Prize: $25,480.00.
Grand Prize must be accepted as awarded. If any element of Grand Prize is unused by Winner, no compensation or substitute prize will be awarded, and Sponsor and Administrator disclaim any and all liability in conjunction therewith. Grand Prize is not transferable. No substitutions allowed. DoorDash eGift Card portion of the prize is subject to all its terms and conditions which can be viewed here. Without limitation, eGift Cards are not redeemable for cash except where required by law, transferable, or replaceable if lost, stolen or damaged. eGift Cards do not expire and no fees are deducted when used. All eGift Card redemptions are final. Any unspecified expenses in conjunction with eGift Card redemptions are winner’s sole responsibility.
All applicable federal, state and/or local taxes, as well as any other expenses not specifically included in the Grand Prize description are the sole responsibility of Grand Prize Winner, who will receive an IRS Form 1099 reflecting the value of the Grand Prize. Grand Prize Winner must furnish their social security number as requested in the Winner Documents. Grand Prize Winner further agrees to otherwise fully cooperate with Sponsor/Administrator as to their compliance with governmental tax-reporting requirements.
In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional materials and the terms and conditions of these Official Rules, these Official Rules shall prevail and govern.
8. LIMITATIONS OF LIABILITY: Released Parties (as defined below) are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind affecting the Sweepstakes in any manner, including but not limited to electronic malfunction or damage of any network, hardware or software. In the event of any discrepancy between the provisions of these Official Rules and any marketing materials (including prize description), the provisions of these Official Rules shall prevail and govern. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond any Released Party’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (including entries or otherwise), Sponsor reserves the right, in its sole discretion, to disqualify any individual, whether or not the individual is a participant in the Sweepstakes, who tampers with the entry process, and to terminate, modify or suspend the Sweepstakes. In such event, Sponsor reserves the right to conduct the Sweepstakes and award Prize by means of a random drawing from among all non-suspect online/App eligible entries received and all eligible e-mail entries received prior to and/or after (as appropriate) the action taken by Sponsor or otherwise in a manner which is fair, appropriate and consistent with these Official Rules, as determined by Sponsor in its sole discretion. Notice of termination/modification/suspension of Sweepstakes will be posted on DoorDash's website and will be posted in app. No responsibility is assumed by any Released Party for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry or participation to be received on account of technical problems or traffic congestion on the Internet or at any website/platform (including the app), or any combination thereof, including any injury or damage to any person's computer or mobile device related to or resulting from participation in or downloading any materials from this Sweepstakes. Failure of Sponsor or Administrator to enforce any provision of these Official Rules shall not constitute the waiver of such provision. All federal, state and local laws and regulations apply.
Persons entering the Sweepstakes further agree not to knowingly damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE, WEBSITE, APP OR PLATFORM OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PERSON, WHETHER OR NOT THE INDIVIDUAL IS A PARTICIPANT IN THE SWEEPSTAKES, MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.
SPONSOR MAKES NO WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
9. RELEASE OF LIABILITY: By participating in this Sweepstakes, entrants agree to release and hold harmless Sponsor, Administrator, DJE Holdings, Inc., as well as each of their parent companies, subsidiaries and affiliates, and their respective officers, directors, employees, agents, partners and representatives and each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes or any Sweepstakes-related activity or travel, and/or acceptance, receipt, possession or use/misuse of the Prize (or any portion thereof).
10. PUBLICITY GRANT: By entering, entrants also authorize the Sponsor, DJE Holdings, Inc., and their respective designees to use their name, voice, likeness, photograph, Prize information (if applicable), biographical data and city and state of residence in programming, advertising and/or promotional material or on a Winner’s list (if applicable) without further compensation, notification or permission, to the extent permitted by law. Sponsor is not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials, at Sponsor's, or DJE Holdings, Inc.’s, (as applicable) sole discretion, without obligation or compensation.
11. DISPUTES; ARBITRATION/CHOICE OF LAW: Except where prohibited, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or the awarding of prize/determination of Winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of JAMS, then effective (notwithstanding the foregoing, entrant shall not be precluded from seeking relief in small claims court for disputes/claims within the scope of the jurisdiction of small claims court and any remedies available to entrant under applicable federal, state or local law remain available to entrant and are not waived pursuant to this section); (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased and any and all rights to injunctive relief. The arbitrator hearing such dispute/claim/cause of action shall be neutral and the entrant will have a reasonable opportunity to participate in the selection of the arbitrator. Such arbitration will take place at a location near the entrant’s residence and the entrant has the right to an in-person hearing in the arbitration proceeding, if desired. The arbitration will allow for discovery and/or exchange of non-privileged information between entrant and Sponsor. Should an entrant initiate arbitration pursuant to this section, the entrant shall be responsible for JAMS’s fees to do so (approximately, $250), with all other costs of such arbitration being borne solely by Sponsor. If entrant is a California resident and Sponsor prevails in such arbitration, such entrant will not be responsible for Sponsor’s costs and fees in conjunction with the arbitration proceeding; BUT, IN ALL OTHER CASES, ENTRANT WILL BE RESPONSIBLE FOR SUCH COSTS/FEES IF REQUIRED BY THE ARBITRATOR’S RULING. For the avoidance of doubt, the requirement to arbitrate disputes pursuant to this section is reciprocal and binding both upon entrants and Sponsor. IN AGREEING TO ARBITRATION, YOU ARE GIVING UP YOUR RIGHT TO TRIAL IN A COURT OF LAW. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine of California or any other jurisdiction.
12. PRIVACY POLICY: Personal information provided in conjunction with Sweepstakes entry is subject to Sponsor’s privacy policy, available at https://help.doordash.com/consumers/s/privacy-policy-us?language=en_US.
13. WINNER’S LIST: For the name of winner, mail a separate, self-addressed, stamped envelope to: Your Door to an Epic Summer Sweepstakes, c/o Probability, P.O. Box 1559, Social Circle, GA 30025-1559, for receipt by September 30, 2024.
