Your Door to an Epic Summer Sweepstakes (WNBA Sweepstakes)
OFFICIAL RULES
To enter the "Your Door to an Epic Summer Sweepstakes" ("Sweepstakes"), you must agree to and abide by these official rules ("Official Rules").
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCE OF WINNING.
1. SPONSOR: DoorDash, Inc. ("Sponsor"), 303 2nd St, Suite 800, San Francisco, CA 94107.
2. ADMINISTRATOR: Probability LLC ("Administrator"), 2 Woodstock Meadows Ln, Woodstock, NY 12498.
3. ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States or District of Columbia who meet all of the following criteria: (a) must have a DoorDash account in good standing at time of entry; and (b) who are at least eighteen (18) years of age (or the age of majority in their jurisdiction of residence, whichever is older) ("Entrant"); Any individuals (including but not limited to employees, consultants, independent contractors [including Dashers as well as brand ambassadors/influencers], and interns) who have, within the past six (6) months, performed services for Sponsor, Administrator, DJE Holdings, Inc., the Women’s National Basketball Association and its Member Teams, WNBA Enterprises, LLC (“WNBA”), any organizations responsible for sponsoring, fulfilling, administering, advertising, or promoting the Sweepstakes and/or their respective parent, subsidiary, affiliated, and successor companies (collectively, the "Sweepstakes Parties"), and immediate family and household members of such individuals, are not eligible to enter. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not. In addition, persons who are currently involved in any capacity with any U.S. Professional Women’s Basketball team (including but not limited to U.S. Professional Women’s Basketball players, coaches, front office members and their staffs) are not eligible to participate in the Sweepstakes or win the prize. Void where prohibited or restricted by law.
4. SWEEPSTAKES ENTRY: For eligible individuals, the Sweepstakes begins at 12:00:01 AM Pacific Time ("PT") on July 11, 2024 and ends at 11:59:59 PM PT, on July 17, 2024 ("Sweepstakes Period").
For purposes of these Official Rules, all times are Pacific Time. Sponsor’s computer is the official time-keeping device for the Sweepstakes.
DashPass Members Online/In App Entry: To enter via this method, you must (a) be a current DashPass member, (b) login to your DoorDash account either online (https://doordash.com) or via your DoorDash app, (c) create your DashPass order that (i) includes an item from the Summer of DashPass category and (ii) is from a DashPass merchant as identified on DoorDash ("Order"). Upon submission of your completed Order, you will automatically receive one (1) entry into the Sweepstakes ("Entry"). By submitting an Entry, Entrant is acknowledging and agreeing to these Official Rules. (For clarity, provided that the amount of the DashPass order meets the DashPass minimum subtotal requirement for a given DashPass merchant, the amount of the DashPass order will not improve or affect your odds of winning the prize in the Sweepstakes.) Order cannot be combined with any coupon, discount, offer or promo code. Entry will be void if (x) you are not a current DashPass member at the time you place your order, (y) order is initially accepted by Sponsor but later voided for any reason, or (z) if order is placed, does not meet the DashPass minimum subtotal requirement, or is from a non-DashPass merchant.
If you are not a DashPass member, you can visit https://www.doordash.com/dashpass or download the DoorDash app on a compatible device from the iTunes App Store or Google Play and subscribe to DashPass according to the instructions on the website/app. Please note that you must agree to the DoorDash Consumer Terms and Conditions available here (including without limitation Section 13 regarding DashPass Subscriptions) in order to subscribe to DashPass.
Email Entry Without DashPass Membership or DashPass Purchase: To enter without becoming a DashPass member or placing a DashPass order on DoorDash, send an email during the Sweepstakes Period to sweepstakes@doordash.com with "Your Door to an Epic Summer Sweepstakes Entry" in the subject line. In the body of the email, please state your name, email address and date of birth. Incomplete entries will not be valid.
While you do not need to become a DashPass member or place a DashPass order to enter via e-mail entry, you must have an active DoorDash account in good standing at time of entry. You can visit http://www.doordash.com or download the DoorDash app on a compatible device from the iTunes App Store or Google Play and create a DoorDash account with a valid form of accepted payment on file according to the instructions on the website/app. Please note that you must agree to the DoorDash Consumer Terms and Conditions available here (including without limitation Section 6 regarding User Accounts) in order to create an account.
Limit of one (1) Entry per person, regardless of method of Entry. Multiple entries and/or mass entry attempts may result in disqualification of all entries by Entrant and may constitute an act of fraud. Whether or not you place a DashPass order (and, if so, the DashPass merchant with whom the order is placed, and the items purchased via the order) will NOT improve or affect one’s chances of winning the prize in the Sweepstakes. Incomplete entries will not be accepted. Entries must be manually key-stroked by the Entrant; use of automated entry devices or programs, or Entries by third parties are prohibited. Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than stated in these Official Rules will be disqualified. Proof of submission of Entry (including acceptance and delivery of DashPass order, if applicable) does not constitute proof of receipt of same. Receipt of online Entries may be acknowledged, but any such acknowledgment is in no way otherwise binding upon Sponsor or Administrator. By entering this Sweepstakes, Entrants agree to these Official Rules and the decisions of the Administrator and Sponsor, which are binding and final in all matters relating to this Sweepstakes.
IMPORTANT: Data rates may apply if Sweepstakes entry is submitted via your mobile device according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging/data rate plans and charges relating to your participation in this Sweepstakes. Mobile device service may not be available in all areas. Check your device's capabilities for specific instructions.
5. RANDOM DRAWING/SELECTION OF WINNER/ODDS: One (1) potential winner ("Winner") will be selected from among all eligible entries received during the Sweepstakes Period in a random drawing, on or about July 19, 2024. The drawing will be conducted by the Administrator, an independent judging organization/administrator whose decisions are final and binding on all matters related to the Sweepstakes.
Odds of winning depend on the total number of eligible entries received.
6. WINNER NOTIFICATION: Potential winner will be notified by e-mail and/or telephone on or about July 22, 2024. Potential winner must still have an active DoorDash account (and, if they entered via DashPass order, an active DashPass membership) in good standing at time of winner notification. Failure to respond to the initial notification e-mail within twenty-four (24) hours after transmission to the potential winner or return of the e-mail notification as undeliverable after two (2) attempts will result in disqualification and award of the Prize may go to an alternate winner (time permitting). Potential winner will be required to complete, sign and return within three (3) business days of transmission, an Affidavit of Eligibility, Liability Release and Indemnification, a Publicity Release where allowed by law, as well as other documents that Sponsor may require (collectively the "Prize Claim Documents"). Failure to return the completed and signed Prize Claim Documents within the indicated time period may result in disqualification, prize forfeiture and selection of an alternate potential winner from among all remaining eligible entries received (time permitting).
In the event of any dispute concerning the identity of any online/app entrant, the entry will be deemed submitted by the natural person who is the authorized account holder of the e-mail address associated with the corresponding DoorDash account used to enter and such individual must comply with these rules. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
7. PRIZE/APPROXIMATE RETAIL VALUE ("ARV"):
One (1) Grand Prize ("Grand Prize"): One (1) Winner will receive the following prize package: Four (4) tickets for Winner and up to three (3) guests (the "Group") to the next two (2) seasons of the WNBA in his/her hometown (Collectively “Game(s)”). Group is responsible for their transportation to and from every Game, meals and any other expense to attend the Game(s). If Winner or guests do not attend a Game after they have received the tickets for any reason whatsoever, Sponsor shall have no further obligation to award that portion of the prize. Total ARV of Grand Prize: up to $3,500.00.
In the event the Winner is able to attend a Game but the Game (or any portion thereof) does not or cannot take place as scheduled or at all, for reasons including but not limited to cancellations, postponement, location changes, an event of force majeure, or for any other reason, then Sponsor or WNBA has no further obligation to the winner for that part of the prize.
WNBA games, dates and times are determined in the sole discretion of WNBA and/or the applicable WNBA team, as applicable, and may be subject to change. Exact seat locations will be determined by Sponsor. The terms and conditions of the tickets awarded as prizes will govern in the event any Game is not played due to weather, an Act of God, an act of terrorism, civil disturbance, work stoppage or any other reason. Winner and his/her guest(s) agree to comply with all applicable stadium regulations in connection with the Prize. Sponsor and the applicable WNBA Entities reserve the right to remove or deny entry to Winner and/or his/her guest(s) who engage(s) in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at any game, event or exhibition. Released Parties (as defined below) will not be responsible for weather, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other event that may cause the cancellation or postponement of any WNBA game.
8. ADDITIONAL PRIZE RESTRICTIONS: Specific seat location at Event is of Sponsor’s sole determination. Ticket privileges are provided to winner and guest(s) pursuant to a revocable, nontransferable license that is personal to winner/guest(s) and may not be sold, resold, auctioned, bartered, assigned, exchanged, placed in commerce, transferred, given away, donated, or otherwise conveyed. Attending the Event constitutes agreement of winner/guest(s) (if any guest is a minor in their jurisdiction of residence, their parent/legal guardian) to the terms and conditions of such tickets, including compliance with all applicable laws and regulations as well as venue policies, including those intended to prevent the spread of COVID-19/Coronavirus (e.g., mask-wearing, provision of proof of vaccination, provision of proof of negative COVID-19/Coronavirus test). Sponsor, WNBA and/or venue may revoke ticket privileges or admission to Game at any time for, amongst other things, failure of the holder to conduct themselves in accordance with WNBA’s Fan Code of Conduct while at venue at any time before, after or during any portion of the Game or if Winner or guest(s) is (are) determined to be intoxicated, to pose a safety risk to themself or others, to violate any applicable law or venue policy, or engages in any conduct that brings Sponsor, WNBA and/or venue into disrepute.
Winner and guest(s) will be solely responsible for obtaining valid identification to enter the venue. Guest(s) of Winner must complete, sign and return a Liability Release, Publicity Release (where lawful) prior to the Game. If any guest is a minor in their jurisdiction of residence, such minor’s parent/legal guardian must be the Winner (or another guest of the Winner) and sign a Release on their behalf.
Actual final value of Prize may vary depending upon the number of guests in Group; and, under no circumstances will the Winner receive the difference between ARV and actual final value of Prize in cash (or in any other form). Prize is non-transferable and cannot be extended beyond the date set forth above. Winner is solely responsible for all other expenses related to Game not specified herein, including but not limited to: transportation to/from the Game, any fees, meals, tips, or taxes. The Sponsor and its agencies are not liable for any expenses incurred as a consequence of Game cancellation/delay.
Winner and guest(s) must follow all instructions of Sponsor/WNBA. Failure to do so may result in forfeiture of the prize. Should winner and/or guest(s) fail to adhere to any such instructions or engage in unruly, obnoxious, illegal, threatening, or otherwise inappropriate behavior (as determined by Sponsor/WNBA in their sole discretion), Sponsor/WNBA reserve the right, without further notice or warning, to terminate prize early, and send Winner and/or Winner’s guest home and/or take other actions as Sponsor/WNBA deem appropriate in their sole discretion without any liability or other obligation to Winner or any guest(s). Inappropriate behavior includes but is not limited to the failure of the winner or guest to comply with governmental mandates, venue or WNBA rules, requirements or policies (including those designed to prevent the spread of COVID-19 (such as, mask-wearing, social distancing, completion of health questionnaire)). Participation in applicable activity/activities may also be conditioned upon proof of a negative COVID-19 test or satisfactory proof of being fully vaccinated against COVID-19.
In connection with any visit to any location in connection with the Prize, please be advised that Sponsor’s policies, CDC guidelines, and the recommendations of health officials must be followed. Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and Sponsor cannot guarantee that any person will not be exposed during the Trip. For clarity, the preceding includes but not is limited to the Game at venue.
NOTWITHSTANDING THE FOREGOING, IT IS ALSO POSSIBLE THAT THE COVID-19/CORONAVIRUS PANDEMIC DIRECTLY OR INDIRECTLY MAY COMPEL WNBA TO DELAY/POSTPONE INDEFINITELY (OR FOR A SIGNIFICANT PERIOD) OR EVEN CANCEL ALTOGETHER THE EVENT (OR PORTION THEREOF). IN SUCH CASE (WITH A SIGNIFICANT DELAY BEING DETERMINED BY SPONSOR IN ITS SOLE DISCRETION), SPONSOR’S LIABILITY SHALL BE LIMITED TO AWARD THE REMAINDER OF THE PRIZE WITH NO FURTHER OBLIGATION TO THE WINNER AND GUEST(S).
WNBA is not responsible for administering this Sweepstakes or selecting the winner. Prize is not redeemable for cash or transferable. No substitutions allowed, except as set forth in these Rules and at Sponsor/WNBA’s sole discretion, a prize of comparable or equal value will be provided. Prize is awarded "as is" with no warranty or guarantee by Sponsor or WNBA. Federal, state and local taxes as well as all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the Winner.
All applicable federal, state and/or local taxes are the sole responsibility of the Winner, who will receive an IRS Form 1099 reflecting the actual final retail value of any prize valued at $600 or more. For prizes valued over $600, Winner must submit their social security number as part of the Winner Documents. Winner further agrees to otherwise fully cooperate with Sponsor/Administrator as to their compliance with governmental tax-reporting requirements.
In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional materials and the terms and conditions of these Official Rules, these Official Rules shall prevail and govern.
9. LIMITATIONS OF LIABILITY: Released Parties (as defined below) are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind affecting the Sweepstakes in any manner, including but not limited to electronic malfunction or damage of any network, hardware or software. In the event of any discrepancy between the provisions of these Official Rules and any marketing materials (including prize description), the provisions of these Official Rules shall prevail and govern. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond any Released Party’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (including entries or otherwise), Sponsor reserves the right, in its sole discretion, to disqualify any individual, whether or not the individual is a participant in the Sweepstakes, who tampers with the entry process, and to terminate, modify or suspend the Sweepstakes. In such event, Sponsor reserves the right to conduct the Sweepstakes and award Prize by means of a random drawing from among all non-suspect online/App eligible entries received and all eligible e-mail entries received prior to and/or after (as appropriate) the action taken by Sponsor or otherwise in a manner which is fair, appropriate and consistent with these Official Rules, as determined by Sponsor in its sole discretion. Notice of termination/modification/suspension of Sweepstakes will be posted on DoorDash's website and will be posted in app. No responsibility is assumed by any Released Party for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry or participation to be received on account of technical problems or traffic congestion on the Internet or at any website/platform (including the app), or any combination thereof, including any injury or damage to any person's computer or mobile device related to or resulting from participation in or downloading any materials from this Sweepstakes. Failure of Sponsor or Administrator to enforce any provision of these Official Rules shall not constitute the waiver of such provision. All federal, state and local laws and regulations apply.
Persons entering the Sweepstakes further agree not to knowingly damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE, WEBSITE, APP OR PLATFORM OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PERSON, WHETHER OR NOT THE INDIVIDUAL IS A PARTICIPANT IN THE SWEEPSTAKES, MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.
SPONSOR MAKES NO WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
10. RELEASE OF LIABILITY: By participating in this Sweepstakes, entrants agree to release and hold harmless Sponsor, Administrator, DJE Holdings, Inc., the Women’s National Basketball Association, its Member Teams and WNBA Enterprises, LLC, as well as each of their parent companies, subsidiaries and affiliates, and their respective officers, directors, employees, agents, partners and representatives and each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes or any Sweepstakes-related activity or travel, and/or acceptance, receipt, possession or use/misuse of the Prize (or any portion thereof).
11. PUBLICITY GRANT: By entering, entrants also authorize the Sponsor, DJE Holdings, Inc., and their respective designees to use their name, voice, likeness, photograph, Prize information (if applicable), biographical data and city and state of residence in programming, advertising and/or promotional material or on a Winner’s list (if applicable) without further compensation, notification or permission, to the extent permitted by law. Sponsor is not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials, at Sponsor's, or DJE Holdings, Inc.’s, (as applicable) sole discretion, without obligation or compensation.
12. DISPUTES; ARBITRATION/CHOICE OF LAW: Except where prohibited, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or the awarding of prize/determination of Winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of JAMS, then effective (notwithstanding the foregoing, entrant shall not be precluded from seeking relief in small claims court for disputes/claims within the scope of the jurisdiction of small claims court and any remedies available to entrant under applicable federal, state or local law remain available to entrant and are not waived pursuant to this section); (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased and any and all rights to injunctive relief. The arbitrator hearing such dispute/claim/cause of action shall be neutral and the entrant will have a reasonable opportunity to participate in the selection of the arbitrator. Such arbitration will take place at a location near the entrant’s residence and the entrant has the right to an in-person hearing in the arbitration proceeding, if desired. The arbitration will allow for discovery and/or exchange of non-privileged information between entrant and Sponsor. Should an entrant initiate arbitration pursuant to this section, the entrant shall be responsible for JAMS’s fees to do so (approximately, $250), with all other costs of such arbitration being borne solely by Sponsor. If entrant is a California resident and Sponsor prevails in such arbitration, such entrant will not be responsible for Sponsor’s costs and fees in conjunction with the arbitration proceeding; BUT, IN ALL OTHER CASES, ENTRANT WILL BE RESPONSIBLE FOR SUCH COSTS/FEES IF REQUIRED BY THE ARBITRATOR’S RULING. For the avoidance of doubt, the requirement to arbitrate disputes pursuant to this section is reciprocal and binding both upon entrants and Sponsor. IN AGREEING TO ARBITRATION, YOU ARE GIVING UP YOUR RIGHT TO TRIAL IN A COURT OF LAW. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine of California or any other jurisdiction.
13. PRIVACY POLICY: Personal information provided in conjunction with Sweepstakes entry is subject to Sponsor’s privacy policy, available at https://help.doordash.com/consumers/s/privacy-policy-us?language=en_US.
14. WINNER’S LIST: For the name of winner, mail a separate, self-addressed, stamped envelope to: Your Door to an Epic Summer Sweepstakes (WNBA Sweepstakes), c/o Probability, P.O. Box 1559, Social Circle, GA 30025-1559, for receipt by September 30, 2024.
